In view of the Contractor`s obligation to provide catering, concierge and laundry services for the offshore facilities of the contractor (hereinafter referred to as `vessels`) and contracting entities that agree to provide catering, concierge and laundry services, it is mutually agreed, as set out in Annex 1: with the exception of the food-related changes, another important change introduced in the CPA in 2019 is the inclusion of the e-commerce sector. E-commerce is defined in Section 2(16) of the CPA, 2019, as “buying or selling goods or services, including digital products via digital or electronic networks”. Section 2(17) of the CPA, 2019 then defines an electronic service provider as “a person who provides technologies or processes that enable a seller of products to promote or sell goods or services to a consumer and covers any online marketplace or online auction site. The CPA, 2019 efforts to include all organizations engaged in the sale of goods or services online. It is also important to read the definition of the concept of `consumer` in Section 2(7) of the CPA, 2019. It is also important to keep in mind that the definition of “consumer” in Section 2(7) of the CPA, 2019 allows for clear reference to online transactions. In addition, the definition of “services” has been extended to the definition of “services” as defined in Section 2(42) of the CPA, 2019, and lists “transportation” as one of the services. Therefore, Food Aggregators or Food Delivery Platforms that participate in the transport of food will provide services within the framework of the CPA 2019. Consumers will therefore turn to consumer forums to settle consumer disputes with service providers. Since the services offered by Food Aggregators or Food Delivery Platforms are consumer-oriented, food delivery platforms fall within the scope of the Consumer Protection Act 2006, as amended from time to time, outside the Food Safety and Standards Act 2006.
As we are aware that consumer legislation is in line with the protection of consumers` interests and rights and that they are included in the CPA 2019. The entry into e-commerce has broadened this scope of the CPA 2019 and has allowed consumers to make food aggregators or food delivery platforms responsible for the violation of their rights. It is very obvious that there is a move from caveat emptor (buyer`s attention) to Caveat Venditor (Seller`s attention). Any contract/agreement must comply with the laws of the nation. Otherwise, they will be held ultra-vires according to the law. Compliance with the laws becomes very important to run a business. The aforementioned legal requirements must be met and the necessary authorizations must be considered mandatory. Both the user and the food delivery platform must comply with all the laws and regulations of the country in which they live, while accessing and using the services. The services offered by the contractor include catering, housekeeping, concierge and laundry services for the contractor`s offshore facilities, namely __ .
